Law Enforcement Request Guidelines

Procedures and requirements for submitting lawful requests for user information, account activity, or other data.

Dotinx is committed to cooperating with law enforcement and regulatory authorities in Nigeria while also protecting the privacy and rights of our users in accordance with the Nigeria Data Protection Act (NDPA) 2023 and other applicable laws.

  1. 1. Legal Basis for Requests

    Dotinx will only respond to requests submitted under valid Nigerian legal authority, including:

    • Court orders issued by a competent Nigerian court
    • Warrants issued under the Cybercrimes Act 2015
    • Written directives from authorized agencies (e.g., EFCC, NPF, DSS, NFIU) pursuant to enabling laws
    • Regulatory demands issued under the authority of CBN or SEC
    • Requests required by the Money Laundering (Prevention and Prohibition) Act 2022

    Requests must clearly cite the legal basis under which they are made.

    Dotinx does not provide user information in response to informal, verbal, undocumented, or extrajudicial requests.

  2. 2. Types of Requests Dotinx May Respond To

    Dotinx can respond to the following categories when supported by appropriate legal authority:

    a. Basic Subscriber Information

    • Registered name
    • Account creation date
    • Linked email or phone number
    • KYC verification data (if applicable)

    b. Transactional & Platform Activity Data

    • Crypto transaction logs
    • Funding and withdrawal history
    • Platform login records
    • IP address and device information
    • Communication metadata

    c. Account Preservation Requests

    • Requests to preserve account data pending legal process
    • Preservation is limited to 90 days, renewable upon valid instruction

    d. Data Disclosure Requests

    • Detailed logs or user information as mandated by a court order, warrant, or regulatory authority

    e. Requests Related to Fraud, Money Laundering, or Terrorist Financing

    Dotinx cooperates with the EFCC, NFIU, and other competent agencies for crime prevention and investigation.

  3. 3. Requirements for Law Enforcement Requests

    To ensure timely processing, all requests must include:

    • Official letterhead of the requesting agency
    • Name, position, and contact details of the requesting officer
    • Clear legal basis (statute, section, or instrument)
    • Case reference number or investigation ID
    • Specific details of the information being requested
    • Timeframe for which data is requested
    • Court order or warrant (if applicable)
    • Certification of authenticity
    • Assurance of compliance with NDPA 2023 and due process requirements

    Incomplete requests may be delayed or rejected.

  4. 4. How to Submit a Law Enforcement Request

    Dotinx may request further verification to confirm the authenticity of the request.

  5. 5. Emergency Requests

    Dotinx may process emergency requests without a court order only where permitted under Nigerian law, such as:

    • Imminent threats to life, safety, or national security
    • Urgent cybercrime prevention situations

    The request must:

    • Clearly explain the nature of the emergency
    • Provide supporting justification under Nigerian laws
    • Be submitted via an official agency email address

    Such disclosures will be limited, documented, and reviewed for legality.

  6. 6. Data Protection & User Privacy

    Dotinx will disclose only the minimum amount of information necessary to comply with the request and Nigerian laws.

    All disclosures are made in accordance with:

    • NDPA 2023 (data minimization, purpose limitation, and accountability principles)
    • Cybercrimes Act 2015
    • Internal security and privacy standards

    Dotinx may notify users of requests unless prohibited by law, judicial order, or security directive.

  7. 7. Response Timeline

    Response times depend on the nature of the request:

    • Emergency requests: As soon as reasonably possible
    • Standard requests: Within 7–14 business days
    • Court orders/warrants: Within timeframe specified in the legal instrument

    Delays may occur if documents are incomplete or unclear.

  8. 8. Cost Reimbursement

    Dotinx may, where permitted, charge administrative recovery fees for:

    • Extensive data retrieval
    • Expert witness testimony
    • Forensic analysis
    • Complex or high-volume requests

    Emergency and legally mandated requests are typically processed without charge.

  9. 9. Data Retention Policy

    Dotinx retains data in line with:

    • NDPA 2023
    • Money Laundering Act 2022
    • Cybercrimes Act 2015
    • Dotinx internal retention standards

    If requested data is no longer retained, Dotinx will notify the requesting agency accordingly.
